"Customer Data" refers to information submitted, uploaded, or transmitted by you or on your behalf while using the Services. You retain all rights to your Customer Data.

You grant Cybersenz a limited license to process, store, and transmit Customer Data solely to provide the Services and improve functionality. We do not sell Customer Data.

We implement industry-standard security measures designed to protect Customer Data from unauthorized access, disclosure, or loss. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute protection.

4. Intellectual Property

The Cybersenz platform, including software, design, logos, documentation, and content, is owned by Cybersenz and protected by applicable intellectual property laws.

You may not:

• Copy, distribute, or create derivative works
• Remove proprietary notices
• Use Cybersenz branding without written consent

5. Confidentiality

Both parties agree to maintain the confidentiality of non-public information exchanged during use of the Services. Confidential information may not be disclosed to third parties except as required by law.

6. Third-Party Services

The Services may integrate with third-party platforms. Cybersenz is not responsible for the performance, availability, or data handling practices of third-party providers. Use of those services is governed by their own terms.

7. Service Availability

Cybersenz strives to maintain reliable uptime but does not guarantee uninterrupted access. We may modify, suspend, or discontinue part of the Services at any time with reasonable notice when possible.

8. Fees and Billing

If you subscribe to a paid plan:

• Fees are billed according to the terms in your order form or agreement
• Payments are non-refundable unless required by law
• We may suspend access for overdue accounts

9. Disclaimer of Warranties

The Services are provided "as is" and "as available."

Cybersenz disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law:

• Cybersenz shall not be liable for indirect, incidental, special, or consequential damages.
• Cybersenz's total liability under these Terms will not exceed the amount paid by you for the Services in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Cybersenz harmless from claims, damages, liabilities, and expenses arising from:

• Your misuse of the Services
• Violations of these Terms
• Infringement caused by Customer Data or your actions

12. Termination

We may suspend or terminate your access to the Services if you violate these Terms or fail to pay fees. Upon termination:

• Your rights to use the Services end
• We will retain Customer Data only as required by law or agreement

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

14. Changes to the Terms

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
